North Branch files motion to dismiss Andirons sewer revocation case
NEWFANE - North Branch Fire District has filed a motion to dismiss a lawsuit brought against the sewer district by Andirons Re-Development Company LLC.
Andirons’ original complaint was filed by Andirons in Windham Superior Court in February. It accuses North Branch of acting unlawfully when it revoked sewer allotment from Andirons. A component of the complaint was what Andirons called a lack of notice to Andirons owner Richard Caplan, of Dover, of revocation.
