BURLINGTON- Vermont District Bankruptcy Court Judge Colleen Brown has ordered a hearing this week on Berkshire Bank's emergency motion to compel the closing of the sale of Hermitage property.
Berkshire Bank filed their motion on Friday, after the Hermitage Club Member Group failed to close on the deal by an April 30 deadline. On Monday, the Hermitage Member Group filed an objection to the motion. In their objection, the group says it has been the bankruptcy trustee, not Hermitage Members, that has failed to meet the terms of the purchase and sale agreement.
