Bankruptcy judge lifts stay on whistleblower case

BURLINGTON- Vermont District Bankruptcy Court Judge Colleen Brown has signed an order allowing former Hermitage Club managing directors Robert Balewicz and John Santaniello to proceed with a federal whistleblower retaliation claim, as well as a state civil action against the Hermitage and former Hermitage officials.
Under Brown’s order, if Balewicz and Santaniello are successful in their actions, they can only seek payment of any judgment through a $5 million Hermitage insurance policy.
