AMENDMENT TO The North Branch Fire
District #1
ORDINANCE IN FORCE
dated SEPTEMBER 10, 2020

This amendment shall become effective 60 days after its adoption by the North Branch Fire District #1, Prudential Committee on September 8, 2021.  If a permissive referendum is filed pursuant to 24 V.S.A. § 1973, that statute shall govern the effective date.  

This amendment shall be in full force and effect from and after its passage, approval, recording and publication as provided by law.  

AMENDMENT:  The Prudential Committee voted to repeal a prior amendment to the Ordinance which became effective August 10, 2021. The deleted prior amendment, made to Section 11.03, provided that:

This Ordinance is subject to amendment, as provided by law, only on the expiration of a five-year moratorium calculated from the effective date of this amendment. The foregoing shall not be construed to prevent, (sic) or restrict the prudential Committee from conducting a statutorily mandated annual review of Fire District rates and charges, (sic) and the basis on which they are established and imposed, nor (sic) from responding to conditions found by the Prudential Committee, (sic) to constitute an emergency, (sic) or public health hazard, nor (sic) from implementing any periodic review currently required by the terms of this ordinance. 

The reason for the repeal of the August 20, 2021 amendment—which appears to be prohibited by the section of the ordinance it seeks to eliminate—is that the prior amendment was improper and illegal.  It is unconstitutional for a legislative body to bind a future legislative body.  See Stone v. Missouri, 101 U.S. 814, 818 (1879) (“No legislature can curtail the power of its successors to make such laws as they may deem proper...”); and Ohio Life Insurance & Trust Co. v. Debolt, 57 U.S. (16 How.) 416, 431 (1853) (“...no one Legislature can, by its own act, disarm their successors of any of the powers or rights of sovereignty...”). In addition, such a practice is inconsistent with the basic principles of democracy.  See Julian N. Eule, Temporal Limits on the Legislative Mandate: Entrenchment and Retroactivity, 1987 Am. B. Found. Res. J. 379.  

Even if the amendment were constitutional, it would still be illegal, because it  impermissibly conflicts with state statute.  See 24 V.S.A. §§ 1972 (the legislative body of a municipality desiring to adopt an ordinance or rule may vote to adopt it); and 1976 (ordinances may be amended or repealed in accordance with the procedures set forth in Chapter 059). See also In re Appeal of Richards, 174 Vt. 416, 423 (2002) (“local ordinances may not conflict with state law if the ordinance forbids what the Legislature has permitted...”).

Article 3.  To see if the Fire District will accept a downward revision of $200,000 from $1,107,693 to adjust to $907,693 for the Raise and Appropriate for Operations approved at the 2021 Annual Meeting.
